Right of withdrawal

The Right of Withdrawal consists of the possibility for the consumer to withdraw, within fourteen days from receiving the goods, from any distance purchase and receive a full refund of the amount paid for the purchase without any penalty, as provided for by Legislative Decree 185 of 22/05/99, which also includes purchases made via the Internet. The only non-refundable costs are shipping costs, which are excluded from the provisions of Legislative Decree 185/99.

The Customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except in the cases of exclusion specified below. To exercise this right, the Customer must send AZIENDA AGRICOLA RIZZI SOCIETÀ SEMPLICE AGRICOLA a communication within 14 days from the date of receipt of the Products via registered letter with return receipt.

After making a purchase, if you wish to exercise the right of withdrawal, you must proceed as follows:

1. Notify in advance via email at info@aziendaagricolarizzi.it or by phone at +39 342 5006429
2. The operator who receives the call or email will arrange an appointment to collect the package, which MUST contain all the elements listed above.
3. AZIENDA AGRICOLA RIZZI SOCIETÀ SEMPLICE AGRICOLA after verifying the integrity of all product components and related accompanying items, will proceed with the refund of the amount paid, EXCLUDING shipping costs. The refund will be issued within 14 days from the above verification.

The right applies to the Product purchased in its entirety; therefore, if the Product consists of multiple components or parts, it is not possible to exercise withdrawal only on part of the purchased Product.

The right of withdrawal is entirely void if the returned product is not intact, namely:

1. Missing original packaging.
2. Absence of integral parts of the product.
3. Damage to the product for reasons other than transport.

The right of withdrawal does not apply to the supply of food products which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly.

The right of withdrawal is excluded in the following cases, pursuant to Article 59 of Legislative Decree 21/2014:

– orders of products by a non-consumer customer and/or requiring an invoice;
– orders of custom-made or clearly personalized products;
– orders of products that are liable to deteriorate or expire rapidly;
– orders of sealed products that are not suitable for return for hygiene or health protection reasons and have been opened after delivery.

With reference to the cases of exclusion of withdrawal listed above, you are specifically informed and accept that products which “are liable to deteriorate or expire rapidly” include all food products, as the characteristics and qualities of such products are subject to alteration also as a result of improper storage. Therefore, for hygiene reasons and for the protection of Customers, the right of withdrawal is applicable only to products purchased on the website that can be returned to AZIENDA AGRICOLA RIZZI SOCIETÀ SEMPLICE AGRICOLA and placed back on the market without risks to consumers’ health.

Please note that:

the right of withdrawal is excluded in the cases referred to in Article 59 of the Consumer Code and, in particular, for contracts concluded through the e-Shop www.aziendaagricolarizzi.it, with regard to the supply of (i) goods that are liable to deteriorate or expire rapidly; (ii) sealed goods that are not suitable for return for hygiene or health protection reasons and have been opened after delivery; the PR Product is considered opened if the packaging containing it is opened, torn, ripped, even partially, pierced, punctured, or in any way, even slightly, compromised, resulting in the loss of the right of withdrawal, pursuant to Article 59, paragraph 1, letter e) of the Consumer Code; even in the case of unopened PR Product packaging, given the type of product and the regulations protecting food safety, if the returned PR Product has lost its organoleptic properties or is in any way deteriorated and/or harmful to health and/or contaminated such that it cannot reasonably be consumed under such conditions and/or is unfit for human consumption, it will be deemed that the PR Product, as it can no longer be placed back on sale, has suffered a loss in value equal to the full purchase price of the PR Product.

Whenever you wish to exercise the right of withdrawal, it is always advisable to send a complaint via certified email (PEC) or registered letter with return receipt to the seller.

NON-CONFORMITY DEFECTS

In the event of non-conformity defects of Products sold by AZIENDA AGRICOLA RIZZI SOCIETÀ SEMPLICE AGRICOLA, the Customer must immediately contact info@aziendaagricolarizzi.it or call 3425006429.

The sale of Products is subject to the legal guarantees provided by Articles 129, 130 and 132 of the Consumer Code. The Customer has the right to have the goods brought into conformity, free of charge, by repair or replacement, or to an appropriate reduction in price or termination of the contract. The Customer forfeits these rights if they do not report the non-conformity defect to AZIENDA AGRICOLA RIZZI SOCIETÀ SEMPLICE AGRICOLA in a timely manner, providing photographic documentation or, if the defect is not visible, a detailed description.
